Is it legal for me to hold a Poker tournament at my house where I make no profit(unless i win)? Lets say that everyone puts down $20 and gets a stack of chips. The one with the most chips leaves with the pot. Is that legal? if not what would make it legal?

Its your house right????? Unless your having random people over that you don't know and your making flyers and making a profit every night and such. But F them all ITS YOUR HOUSE!!!!!

No it is not legal, it is called gambling. I just don't understand how horse racing is legal though.

My understanding on poker is.. Has long has the house doesn't charge or take a % then it is legal.. We need Bubba for this one..

This was my understanding.

I know it's a form of gambling, but it is a legal form. I was just told on another site that if you have all the players buy the chips as they walk into the house and not at the table then it makes it legal. That way players are playing for chips and not money.

Oh well, I'm just trying to find out. It's not going to keep me from doing it, I am just curious. :2thumbs:

et noire, rondo, tan, fan-tan, seven-and-a-half, twenty-one,
hokey-pokey, or any banking or percentage game played with cards,
dice, or any device, for money, checks, credit, or other
representative of value, and every person who plays or bets at or
against any of those prohibited games, is guilty of a misdemeanor,
and shall be punishable by a fine not less than one hundred dollars
($100) nor more than one thousand dollars ($1,000), or by
imprisonment in the county jail not exceeding six months, or by both
the fine and imprisonment.


331. Every person who knowingly permits any of the games mentioned
in Sections 330 and 330a to be played, conducted, or dealt in any
house owned or rented by such person, in whole or in part, is
punishable as provided in Sections 330 and 330a.

And this is where I would say BFD. You're doing it in your own house, and it's just one of those "poker nights" that a lot of people participate in no one is going to give a flying fawk one way or another. I'd think you'd be hard pressed to find someone that's been charged with having a poker night. Didn't MJF have these every so often?

Technically no. Any gambling involving real cash is not legal unless in a licensed card room or casino. The govt wants their cut.

who cares, just play the game and agree to pay the winner of the king of the hill.

kinda like fantasy football and such.

besides, you think the cops are gonna bust into a house for poker. na, here in Modesto they have too many gangs and drugs to hash out the little things. although they do enforce traffic for revenues. i'll have to give em that. last ticket was for $328. speeding.....ouch

I have and do play all the time. I was just curious as to what was legal and what was not. :D

I think if for some reason the cops where called. They wouldn't do anything if they didn't see the money.. Just put it all in a box and only use chips.. Then you can just say you where playing for chips..

Yup we do it all the time, just don't advertise. Problem comes when you invite people who invite people who invite people without asking you.
